These Terms and Conditions govern the use of the email marketing service Jolamail Mailing (hereinafter "Service"), operated at mailing.jolamail.com. By registering, the user accepts these Terms. The contract language is German; the German version is the legally binding original.
Jolamail Mailing provides a web-based platform for registered users to create, manage and send email campaigns, based on the selected subscription plan.
The Service stores technically necessary data such as recipient email addresses, campaign content and send statistics. The user is solely responsible for the legality of recipient data they manage.
Available plans and current prices are displayed on the platform at /dashboard/billing. The price shown at the time of booking applies. Price changes will be communicated by email at least 30 days in advance.
Paid subscriptions are cancelable monthly. Cancellation is possible at any time via the dashboard billing page or by email to support, and takes effect at the end of the current billing month. The free plan runs indefinitely and may be terminated at any time.
Consumers have a statutory right of withdrawal. The right of withdrawal for digital services expires once the execution of the contract has begun and the consumer has expressly agreed to this.
The Service is provided "as is". No warranty is given for uninterrupted availability, freedom from errors, or fitness for a particular purpose. Liability for indirect damages, loss of profit or data loss is excluded to the extent permitted by law. Liability for intent and gross negligence, as well as for damages arising from injury to life, body or health, remains unaffected.
The user undertakes to use the Service solely for lawful purposes, in particular to comply with applicable data protection law (GDPR) and anti-spam legislation, not to use misleading sender information, and to provide evidence of recipient consent upon request.
Should any provision of these Terms be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the valid provision that comes closest to the economic purpose of the invalid one.
Changes to these Terms will be communicated to the user by email. If the user does not object within 30 days of receiving the notification, the amended Terms are deemed accepted.
